The Difference in ACN and a Pyramid Scheme

by Robert T. Stephan

ACN is a customer acquisition company. The compensation plan makes it clear that an Independent Business Owner can only receive compensation if customers are obtained. An Independent Business Owner could recruit a thousand or ten thousand other Independent Business Owners, but there is absolutely no compensation paid for that recruiting unless customers are obtained. The payments received by Independent Business Owners are derived primarily from the sale of ACN services and not from recruiting individual participants.

ACN Follows Code of Ethics

The ACN compensation plan complies with requirements set out by the Federal Trade Commission and state consumer protection laws. ACN is a member of the Direct Sellers Association and follows the code of ethics that applies to multilevel business opportunities.

What is an Illegal Pyramid Scheme?

As distinguished from the legitimate multilevel business opportunity advanced by ACN there are some companies who continue to engage in illegal pyramid sales. Simply defined, an illegal pyramid sales program occurs when persons are induced to purchase the right to sell a product by representations that they could regain their purchase price and also earn profits by subsequently selling the same right to sell to others. This certainly does not occur with the ACN Opportunity.

Success is not Guaranteed

ACN not only requires substantial customer acquisition but makes it clear that not all Independent Business Owners make a profit and no one can be guaranteed success as an ACN Independent Business Owner. Success can only come through individual specific efforts in acquiring customers and recruiting other Independent Business Owners who must also acquire customers.

Experienced in Enforcing Laws Against Illegal Pyramid Scams

Very early on the Co-Founders of ACN organized a Legal Advisory Committee of attorneys who were familiar with state consumer protection laws. They also wanted to make certain that the advisory committee would include individuals with experience enforcing laws against illegal pyramids.

ACN proceeded to engage three former Attorneys General to guide them with appropriate legal advice. The Legal Advisory Committee was created with Chris Gorman, former Kentucky Attorney General; Grant Woods, former Arizona Attorney General; and me, Bob Stephan, former Kansas Attorney General. We are honored to include in our number the former Supreme Court Judge of Ontario Canada, Honourable William P. McKeown, and in Australia, Warren Pengilley, Former Commissioner of the Australian Trade Practices Commission.

ACN Conducts Business with Integrity

ACN has reason to be proud of its commitment to a compensation plan that not only adheres to legal requirements but also to its continuing resolve to conduct business with integrity.
